MAPSCAN.AI TERMS OF SERVICE


Effective Date: March 1, 2025


These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and services provided by Mohsin Enterprises LLC d/b/a MapScan.ai (“MapScan.ai”, “we”, “our”, or “us”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use our Services.


1. DEFINITIONS
  • “Services”: All websites, software, applications, APIs, dashboards, tools, and features provided by MapScan.ai.

  • “User”, “you”, “your”: Any individual or entity accessing or using our Services.

  • “Account”: Your registered profile with MapScan.ai.

  • “Content”: Any data, text, images, or other materials submitted, generated, or displayed through the Services.


2. ELIGIBILITY

You must be at least 18 years old and legally able to enter into binding contracts to use our Services. By using the Services, you represent and warrant that you meet these requirements.


3. ACCOUNT REGISTRATION

You may be required to create an Account to access certain Services. You agree to:

  • Provide accurate, complete, and current information.

  • Maintain the confidentiality of your login credentials.

  • Be responsible for all activities under your Account.


We reserve the right to suspend or terminate your Account if information provided is false, misleading, or violates these Terms.


4. USE OF SERVICES

You agree to use the Services only for lawful purposes and in compliance with these Terms. You shall not:

  • Copy, modify, or distribute any part of the Services without authorization.

  • Interfere with or disrupt the operation of the Services.

  • Use automated bots or scrapers to extract data from the Services without written permission.

  • Misuse APIs or integrate our Services in ways not authorized.

  • Submit harmful, unlawful, or infringing Content.


We may suspend or terminate your access for violations.


5. SUBSCRIPTIONS, PAYMENTS & REFUNDS

Subscriptions & Payments
  • Certain features require a paid subscription. By subscribing, you agree to pay all fees associated with your plan.

  • Payments are billed in advance on a recurring basis (monthly or annually, depending on your plan).

  • We reserve the right to modify pricing at any time, with notice prior to your next billing cycle.


Refund Policy
  • All fees are non-refundable, except as required by law.

  • Refunds will only be considered if:

    1. You were double charged due to a billing error, or

    2. The Services were unavailable for a continuous 72-hour period due to issues on our end.

  • To request a refund under these circumstances, you must contact us within 14 days of the issue.


6. INTELLECTUAL PROPERTY

All intellectual property rights in the Services, including software, algorithms, trademarks, logos, and designs, are owned by or licensed to MapScan.ai.


You are granted a limited, non-exclusive, non-transferable license to use the Services solely for your internal business purposes, subject to these Terms.


You may not reverse engineer, copy, or exploit the Services for competing purposes.


7. USER CONTENT

You retain ownership of any Content you submit. By submitting Content, you grant MapScan.ai a worldwide, royalty-free, non-exclusive license to use, store, and process such Content solely to provide the Services.


You represent and warrant that you own or have the necessary rights to submit such Content.


8. DATA & PRIVACY

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the collection and use of your information as described therein.


9. THIRD-PARTY SERVICES

The Services may integrate with third-party services (e.g., Google, Meta, Microsoft, Stripe). MapScan.ai is not responsible for the actions, data use, or policies of such third parties. Your use of their services is subject to their terms and policies.


10. DATA PROCESSING AGREEMENT (DPA)

This section applies where the General Data Protection Regulation (GDPR), UK Data Protection Act, or similar data protection laws apply and MapScan.ai acts as a data processor on behalf of the User.

  • Scope & Roles: User acts as the data controller, and MapScan.ai acts as the data processor.

  • Processing: We process personal data solely for the purpose of delivering the Services, in accordance with your documented instructions.

  • Security: We implement appropriate technical and organizational measures to protect personal data against unauthorized access, loss, or disclosure.

  • Sub-processors: We may use trusted third-party service providers (e.g., hosting, payment processors) as sub-processors. We remain responsible for their compliance.

  • Data Transfers: If data is transferred outside the EEA/UK, appropriate safeguards (such as Standard Contractual Clauses) will be applied.

  • Assistance: We will assist Users in fulfilling obligations related to data subject rights (access, correction, deletion) and data breach notifications.

  • Deletion or Return: Upon termination of Services, personal data will be deleted or returned to you unless otherwise required by law.


By using our Services, you agree to this DPA framework.


11. DISCLAIMERS

The Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.


MapScan.ai does not guarantee that:

  • The Services will be error-free or uninterrupted.

  • Results from the Services will be accurate, reliable, or meet your expectations.

  • Any bugs or defects will be corrected immediately.


12. LIMITATION OF LIABILITY

To the maximum extent permitted by law, MapScan.ai shall not be liable for:

  • Indirect, incidental, or consequential damages.

  • Loss of profits, revenue, or data.

  • Any damages exceeding the amount you paid to MapScan.ai in the past 12 months.


Some jurisdictions may not allow such limitations, so certain provisions may not apply to you.


13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless MapScan.ai, its officers, employees, and affiliates from any claims, damages, or expenses arising out of:

  • Your use of the Services.

  • Your violation of these Terms.

  • Your violation of any third-party rights.


14. TERMINATION

We may suspend or terminate your Account and access to the Services at any time if you violate these Terms or for any other reason at our discretion.


Upon termination, your right to use the Services will immediately cease.


15. GOVERNING LAW & DISPUTES

These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles.


Any disputes will be resolved exclusively in the state or federal courts located in Collin County, Texas.


16. MODIFICATIONS

We may revise these Terms from time to time. The most current version will always be posted on our Site. By continuing to use the Services, you agree to the revised Terms.
